Terms of Service

1. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when registering.

2. Free Plan and Tokens

New accounts receive a once-off allocation of 20 lead tokens per scraping channel on sign up. These free tokens do not refresh or roll over. Once consumed, additional tokens require upgrading to a paid plan or purchasing token packs. Paid plan allowances reset monthly in accordance with the plan you select.

3. Paid Plans and Billing

Paid plans are billed in advance through our payment provider (Yoco). Fees are non-refundable except where required by law. You authorise us to charge the applicable fees for the plan or token packs you select. Plan prices, features, and allowances may change; any changes to your active plan will be communicated in advance.

All prices displayed on the platform are inclusive of Value Added Tax (VAT) at the applicable South African rate. VAT is included in every purchase made through the Service — no additional VAT will be charged at checkout or on your invoice.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of POPIA or other applicable laws;
• Scrape, harvest, or contact individuals in a manner that breaches the terms of third-party platforms;
• Attempt to access, alter, or damage the platform's systems, data, or other users' information;
• Resell, sublicense, or redistribute lead data obtained through the Service without lawful basis;
• Use automated tools to abuse, overload, or disrupt the Service.

5. Lead Data and Compliance

Yotta generates leads from publicly available sources using AI. You are solely responsible for how you use, store, and contact leads, and for ensuring your outreach complies with POPIA, the Consumer Protection Act, and any applicable marketing regulations. Yotta provides email validation and duplication controls to assist you but does not guarantee the accuracy, deliverability, or legality of any specific lead.

6. Intellectual Property

The Service, its design, branding, and software are the intellectual property of Yotta. Lead records you generate belong to your account for your business use. You retain ownership of content you upload to the Service.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that every lead will be valid or deliverable. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Yotta shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, leads, or profits, arising out of or related to your use of the Service. Our aggregate liability shall not exceed the amount you paid to us in the three months preceding the claim.

9. Termination

You may close your account at any time. We may suspend or terminate access if you breach these Terms or engage in conduct harmful to the Service or other users. Upon termination, your right to use the Service ends; lead data associated with your account may be deleted.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised "last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the South African courts.
